Terms of Hire

Hire period and charges

The hire period starts when the equipment leaves our premises or is delivered to the site, and ends when we collect it or you return it to us in the condition required by these terms. Minimum hire is one day. Weekly, monthly and contract rates are as set out in your quote.

Rates are quoted exclusive of GST unless stated. Delivery and collection are charged as quoted. Long-term agreements attract fixed rates for the agreed term.

Delivery, access and site conditions

You must provide safe and clear access for delivery and collection, a suitable place to store and charge the machine, and — where the machine needs them — water and waste disposal points. You are responsible for the suitability of the floor or surface for the machine supplied.

Operation and training

On dry hire we provide operator training at handover. You must ensure the equipment is operated only by trained, competent people, in accordance with the manufacturer's instructions and your own work health and safety obligations. The equipment must not be modified, sub-let or moved to another site without our written consent.

Maintenance and consumables

We provide scheduled maintenance and service back-up for the hire period. Consumables and wearing parts — brushes, pads, filters, squeegee blades and seals — are included and will be replaced by us as they wear.

You must carry out daily operator checks: empty the hopper or recovery tank, clean or pulse the filter, clear and unload the squeegee, and charge the machine correctly.

Breakdown

If the equipment breaks down through fair wear and tear or mechanical failure, stop using it and contact us immediately. We will repair or replace the machine as soon as reasonably practicable. Hire charges are adjusted for time lost to a breakdown that is not caused by misuse.

We are not liable for consequential loss arising from equipment downtime, to the extent permitted by law.

Damage, loss and risk

Risk in the equipment passes to you for the hire period. Damage arising from lack of care, misuse, impact, operation by untrained persons, or use on unsuitable surfaces is your responsibility: you must pay for replacement parts, repair and any additional expenses, including loss of hire revenue while the machine is out of service.

Fair wear and tear is our responsibility. You must report theft, loss or significant damage to us — and to police where relevant — immediately.

Insurance

Unless your quote states otherwise, you are responsible for insuring the equipment for its full replacement value against loss, theft and damage during the hire period, and for public liability cover appropriate to the work being undertaken. We may ask for evidence of cover before delivery.

Payment and credit

Payment terms are as stated on your quote or account. Where credit has not been approved, payment is required before delivery. Overdue accounts may attract interest and recovery costs, and we may suspend hire or collect the equipment while an account remains unpaid.

Termination and return

Either party may end a periodic hire by giving the notice set out in the quote. On termination or expiry you must make the equipment available for collection, clean and complete, with all attachments supplied. Cleaning and missing-item charges apply where it is not.

Consumer rights and governing law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. These terms are governed by the laws of Queensland, Australia.
